1. General Policy
- All payments made to NxtEdge Technologies are strictly non-refundable.
- Once a payment is initiated, processed, or received, no refund will be issued under any circumstances.
- Proceeding with payment confirms that the Client fully accepts this Refund & Cancellation Policy.
2. Project Cancellation by the Client
- If the Client chooses to cancel the project at any stage, all payments already made remain non-refundable.
- Work that has started or been completed prior to cancellation is fully billable.
- If a milestone has already begun, the Client must pay the full milestone amount, even if the project is canceled during that milestone.
3. Project Cancellation by the Agency
NxtEdge Technologies may cancel or terminate a project due to:
- Non-payment or delayed payments
- Abusive, unethical, or unprofessional client behavior
- Requests involving illegal, misleading, or policy-violating activities
- Missing inputs, delayed approvals, or lack of required access
- Violation of the Agency's Terms & Conditions
In such cases, the Client is not eligible for any refund.
If the Agency cancels the project due to internal operational reasons (rare), a partial refund may be considered only for work that has not yet begun.
4. Non-Refundable Items
The following fees and service categories are 100% non-refundable:
- Consultation fees
- Advance payments or deposits
- Anti-piracy & counterfeit monitoring fees
- Cybersecurity assessments
- UGC content creation fees
- Creator/talent booking charges
- Ad spend, media spend, and third-party payments
- Branding, design, and strategy work
- Software development milestones
- Monthly retainers, service subscriptions, or maintenance contracts
These charges remain non-refundable regardless of project stage or outcome.
5. Delays & Performance Conditions
Refunds will not be issued due to delays caused by:
- Late or incomplete client inputs
- Missed approvals or unresponsiveness
- Platform-related issues (Facebook, Instagram, Google, YouTube, etc.)
- Algorithm changes, account restrictions, or verification delays
- Third-party downtimes including creators, vendors, APIs, or hosting
- Marketing or advertising performance not meeting expectations
No refunds will be provided for "change of mind" after work has begun.
6. No Guarantee-Based Refunds
NxtEdge Technologies does not offer refunds based on performance-related expectations. This includes:
- Sales performance
- Revenue outcomes
- Marketing or ad results
- Viral reach, engagement, or follower growth
- Cybersecurity breach prevention results
- Anti-piracy or counterfeit takedown success rates
Our services are delivered based on professional expertise, effort, and defined deliverables—not guaranteed outcomes.
7. Software Development Refund Conditions
- Refunds are not issued for software development milestones once work has started.
- Partial modules, draft code, prototypes, or in-progress builds are also non-refundable.
- If the Client abandons, pauses, or delays the project, no refund is provided for unused time, resources, or future milestones.
8. Creator, UGC, and Talent Booking Rules
- All creator or talent booking fees are strictly non-refundable.
- If a creator becomes unavailable, the Agency will arrange a suitable alternative rather than issue a refund.
- If the Client rejects content due to personal preference (but not due to mismatch with the brief), no refund will be provided.
9. Third-Party & Platform Costs
Payments made to third parties are non-refundable, including but not limited to:
- Advertising platforms
- Hosting providers
- Domain providers
- API services
- Talent/creator/vendor fees
- Media buying
- Marketplace or platform charges
NxtEdge Technologies is not responsible for delays, failures, bans, or refund issues caused by external platforms.
10. Force Majeure
No refunds will be issued for delays or cancellations resulting from events beyond our control, such as:
- Natural disasters
- Government restrictions
- Platform-wide outages
- Strikes or emergencies
- Cyberattacks or infrastructure failures
These events fall under Force Majeure conditions.
11. Chargebacks & Payment Disputes
- Initiating a chargeback against NxtEdge Technologies is considered a violation of this policy.
- The Agency will provide evidence of completed work to the payment provider or legal authorities.
- False chargebacks or fraudulent disputes may lead to legal action under Chennai jurisdiction.
12. Policy Updates
- NxtEdge Technologies may modify or update this Refund & Cancellation Policy at any time without prior notice.
- The most recent version applies automatically to all new and ongoing projects.
13. Jurisdiction
- All disputes related to payments, refunds, or cancellations are governed exclusively by the courts of Chennai, Tamil Nadu.
- All legal proceedings must be initiated only in Chennai.
